A Kamloops man who hid in the utility room of a North Shore convenience store armed with a large metal pipe has been ordered to spend two months in jail.

Richard Michael Annett-Chartier, 30, pleaded guilty in Kamloops provincial court Thursday to one count each of mischief and breach stemming from an incident on May 16.

Court heard a number of passersby phoned 911 on that day to report a man swinging a large pipe and yelling obscenities behind Tranquille Market, 1170 Tranquille Rd.

When Mounties showed up they couldn’t find anyone in the area. That's when Annett-Chartier “exploded” out of a utility room brandishing the pipe, according to Crown prosecutor Alex Janse.

“He was holding an approximately two-and-a-half-foot metal pipe that he intended to use as a weapon,” she said.

“On seeing it was police, he immediately put down the the pipe and walked toward the members, and he was arrested for possession of a weapon et cetera.”

Janse said Annett-Chartier falsely told police he was the owner of the building and threatened to sue the officers arresting him. When that didn’t work, he claimed to be a powerful member of the Hells Angels, court heard.

A month earlier, on April 16, Annett-Chartier was arrested after the owner of Tranquille Market found him inside the same utility room. In that case, Mounties believed he was living in the room. He was placed on a police undertaking requiring he stay away from the store — the condition he breached on May 15.

Defence lawyer Jamie Gagnon said her client is homeless and dependant on methamphetamine, which he claims to use to treat his attention deficit disorder.

Court heard Annett-Chartier has a history of psychosis, but his drug use has made it impossible for doctors to know for certain what the issue is.

“It’s unclear whether the mental state is caused by illicit drug use, in this case methamphetamine, or if there’s a separate mental health disorder,” Janse said.

“Because he is effectively treating himself with methamphetamine, doctors are unable to make a diagnosis. … I suspect that if he goes back to using street drugs we’ll just see him back here again.”

Annett-Chartier has a lengthy criminal record including multiple convictions for assault and mischief. Last fall, he was sentenced to a month in jail after pulling a can of pepper spray on an employee at a store in Valleyview.

He was sentenced in April to 60 days time served for a February altercation outside The Loop drop-in centre.

Kamloops provincial court Judge Lorianna Bennett sentenced Annett-Chartier to 60 days in jail. He had been behind bars since his arrest on May 15, giving him credit for 69 days and making the sentence another one of time served.

Bennett also placed Annett-Chartier on a 12-month probation order with a condition requiring he stay away from Tranquille Market and ordered he submit a sample of his DNA to a national criminal database.
